Ministry of Finance illegally classified the terms of restructuring of $ 23 billion of public debt

The court recognized that the Ministry of Finance illegally refused to disclose details of debt restructuring by $ 23 billion in 2015.

This became known from the decision of the Kyiv Administrative Court of Appeal of May 17, 2017, which is placed in the court register, reports Economic Truth.

By this decision, the court upheld the findings of the first instance on the illegality of the refusal of the Ministry of Finance to disclose details of the transaction two years ago.

As stated in the lawsuit, Kiev lawyer Alexei Khomyakov in September 2015 appealed to the Ministry of Finance with a request to provide copies of all signed and approved documents relating to borrowings with a total face value of $ 22.6 billion.

In October 2015, the Ministry of Finance informed the requestor that, in accordance with the rules of English law, transactions that were concluded upon the placement of T-bills were confidential and could not be provided to third parties.

The letter also says that an agreement was signed between the Ministry of Finance and the Ad Hoc Committee of Creditors on the non-disclosure of confidential information on the restructuring of state and publicly guaranteed debt. Therefore, this information is not subject to disclosure.

Considering the refusal granted by the respondent unreasonable, Khomyakov appealed to the District Administrative Court of Kyiv, which on February 23, 2017, satisfied his claim.

The Ministry appealed, but lost.

The Administrative Court of Appeal came to the conclusion that the Cabinet did not provide proper and admissible evidence confirming the confidentiality of the information requested by the plaintiff.

It is noted that the Ministry of Finance can file a cassation appeal within twenty days after the court decision.

Recall that in the summer 2015 after semi-annual negotiations Ukraine agreed to restructure almost $ 23 billion of debt. 20% of them - $ 3.6 billion - creditors agreed to write off. The terms of repayment of part of the debt that was not written off were transferred to 2019-2027.
