ECHR has recognized a moratorium on the sale of land in Ukraine, a violation of human rights

The moratorium on the sale of agricultural land in Ukraine by the ECHR decision was recognized as a violation of human rights. This is stated in a press release of the court, writes 112.

"Ukraine's absolute ban on the purchase and sale of agricultural land has led to a violation of human rights, the government must adopt a more balanced law," the message says..

So, today, on May 22, the ECHR adopted a decision in the case of Zelenchuk and Tsitsyura v. Ukraine. Within the framework of the case, a complaint was considered between two Ukrainian citizens, residents of Ivano-Frankivsk and Terpnopol, a moratorium on the sale of agricultural land. They stated that the moratorium violated their property rights as owners of plots.

The ECHR noted that after 1991, Ukraine distributed farmland between those who worked on collective farms before the collapse of the Soviet Union, but a moratorium was also put in place to sell these lands. It was assumed that this is a temporary measure designed to avoid the concentration of land in one hand.

"At the same time, the court found that the state did not determine an equitable balance between the general interests of the community and the property rights of the applicants," the press release says..



According to the decision of the ECHP, the Government of Ukraine undertakes to take measures to ensure an equitable balance for the owners of agricultural land. At the same time, it is stressed that it is not a question of immediately opening an unlimited market for farmland.

Also, the court did not begin to establish pecuniary compensation for the applicants.

Earlier, the World Bank said that a moratorium on the sale of agricultural land prevents the Ukrainian economy from realizing its advantages and causing damage in billions of dollars.
