AMCU sent to GIS a statement on the forcible collection of 172 billion from Gazprom

It is noted that the Economic Court of Kyiv on March 17, 2017 ruled to recover 172 billion UAH from Gazprom on the basis of a final judicial decision.

Recall that the Kiev Economic Court of Appeal upheld the court decision of December 5, 2016, which Gazprom was ordered to pay the fine and fine imposed by the AKU, in the amount of 172 billion UAH. (About $ 6.4 billion) for abuse of monopoly position in the market of natural gas transit through Ukraine.

January 22, 2016 AMCU fined "Gazprom" in the amount of 85.966 billion UAH for abuse of monopoly position in the gas transit market. At the same time, Gazprom was to pay a fine before May 4, 2016.

However, on April 12, 2016, Gazprom filed a suit with the Economic Court of Kiev with a request to invalidate the AMCU's decision, but the suit was not accepted by the court for consideration. Gazprom tried to appeal the ruling of Khozsud Kiev about the return of his claim without consideration, but the higher courts confirmed the legality of the decision.

Then, in October 2016, the AMCU filed a lawsuit against the Economic Court of Kiev on the forcible collection of a fine and a fine. On December 5, the court granted the claim of the AMCU and recovered 172 billion UAH from Gazprom.

The penalty for Gazprom was calculated at 1.5% of the amount of debt for each day of delay (about 1.289 billion UAH. in a day).

According to the law, the fine amount can not exceed the fine. In this regard, AMCU filed a lawsuit to recover 85.966 billion UAH. A fine and 85.966 billion UAH. Penalties.

The Ministry of Energy of Russia on December 9 expressed concern about the decision of the Economic Court of Kiev and called on Ukraine to cancel this decision.

Minister of Energy and Coal Industry Igor Nasalik said that it is impossible to seize transit gas as part of the implementation of the decision of the economic court.
