Thus, from now on, the use of cannabis and marijuana is no longer considered a criminal offense and does not fall under the article "Illegal manufacture, purchase, storage in small amounts for personal use or illegal consumption without the prescription of a doctor of narcotic drugs, their analogues or precursors". Such punishment does not comply with Article 16 of the Georgian Constitution, according to which "everyone has the right to free development of his personality".
The decision of the Constitutional Court says, in particular, that "the human right to choose the form of rest and carry out appropriate activities, including using marijuana, is a sphere protected by the personal autonomy of a person".
Recall, according to current legislation, possession of marijuana weighing more than 70 grams still provides for punishment in the form of restriction of freedom.
