Annual leave during war: how long can it last?

In Ukraine, labor relations between employer and employee are regulated by relevant law. Even during martial law, Ukrainians can go on vacation. Specialists from the South-Eastern Interregional Department of the State Labor Service told how martial law affects the duration of annual leave.

Experts explained that, in accordance with Article 10 of the Law “On Leaves,” an employee’s right to annual basic and additional leaves of full duration in the first year of work begins after six months of continuous work at the given enterprise..

“If an employee is granted the specified annual leave before the end of a six-month period of continuous work, their duration is determined in proportion to the time worked,” the statement says..

Derzhpratsi noted that, for example, an employee who works at an enterprise for 11 months has the right to all types of annual leave of full duration.



“In accordance with Article 12 of the Law of Ukraine “On the Organization of Labor Relations in Martial Law,” during the period of martial law, annual basic paid leave is provided to employees of 24 calendar days,” the statement says..

Experts added that during the period of martial law, the employer may refuse to provide an employee with any type of leave (except for maternity leave and parental leave until the child reaches the age of three), if such an employee is involved in work at critical infrastructure facilities.
