Public activists and media urged deputies to neutralize threats related to the adoption of the Verkhovna Rada of bill No. 12320. It provides for the possibility of establishing fines for mentioning what the lawyer has represented or represents the interests of the client, which threatens freedom of speech, says the website of the public organization Transparency International Ukrane.

It is noted that the bill establishes blurry and subjective criteria for responsibility for new offenses. In particular, such terms as “biased attitude”, “negative pressure” or “personal involvement” do not have a clear legal definition, which creates a wide field for arbitrary interpretation and abuse.

" The recognized European standard is that the media coverage of trials and their participants is very important for a democratic society. Moreover, it should be carried out in compliance with duties and responsibility, balancing the freedom of expression with other rights, ”the organization notes.

It is noted that the coverage of trials contributes to their publicity, and the ban on mentioning lawyers contradicts the principle of publicity. At the same time, the media and public organizations in their communication also have the task of transmitting information about judicial hearings, and citizens are entitled to receive such data.

" It is impossible to understand which actions are unlawful, and for what exactly will be punished, and this, in turn, creates the risk of arbitrary application of the law and violates the principle of legality, ”the activists say.

Activists and media people note that if the law enters into force, its norms will move Ukraine from international standards, where the principle of non -identification of a lawyer with a client is aimed at protecting a lawyer from state pressure, and not from public opinion or informing.

The public and the media urge deputies to cancel the decision of the Verkhovna Rada of July 16 on the adoption of the Law No. 12320 in the second reading and in general, which threatens the freedom of speech and the right of citizens to information.
