Martial law: can an employee of pre -retirement age be fired

In Ukraine, labor relations between the employee and the employer are regulated by the relevant legislation. To receive the necessary insurance experience to appoint a pension, many Ukrainians of pre -retirement age continue their labor activity. Specialists of the South-East Interregional Department of the State Service on Labor said whether they can dismiss a person of pre-retirement age.

The Derzhpraci explained that if the organization has changes, including a reduction in the number or staff of employees in accordance with paragraph 1 of Article 40 of the Labor Code of Ukraine, then the employment contract concluded for an indefinite period may be terminated.

Thus, according to the second part of Article 492 of the Labor Code of Ukraine, it is stipulated that upon dismissal of employees in cases of changes in the organization of production and labor, the pre -emptive right to leave at work, provided for by legislation, should be taken into account.

Experts noted that under equal terms of labor productivity and qualifications, preference in leaving at work is provided, including employees who are less than three years before the retirement age, upon reaching which the person has the right to receive pension payments (paragraph 10 of Article 42 of the Labor Code of Ukraine).
