The Law “On Housing and Communal Services” establishes for the consumer of housing and communal services (HUS) the obligation to pay for the provided HUS at prices / tariffs established in accordance with the law, within the time limits established by the relevant contracts for the provision of HUS, and in case of late payment, pay a penalty.

At the same time, by the resolution of the Cabinet of Ministers of March 5, 2022. No. 206 it was forbidden to charge and collect:.

fines, penalties;

inflation charges;

interest per annum accrued on the debt formed for late and / or incomplete payment of housing and communal services by the population.

It is also prohibited to terminate / stop the provision of housing and communal services to the population in case of non-payment or payment not in full.

In addition, the consumer has the right not to pay for utilities in case of non-use (in the absence of metering devices) for the period of temporary absence of the consumer and other persons in the residential premises for more than 30 calendar days, subject to documentary evidence in accordance with the terms of contracts for the provision of utility services.

To do this, you need to submit an application to the provider of the relevant housing and communal services, to which attach evidence of temporary absence, for example:.

certificate of temporary residence;

certificate of treatment;

military service certificate;

IDP registration certificate.

Benefits, if possible, not to pay for services do not apply to services:.

thermal energy supply;

apartment building management services.

Also, during the period of martial law, enforcement actions are not performed on:.



decisions on the recovery of debts from individuals for housing and communal services in territorial communities located in areas of military (combat) operations, or located or were in temporary occupation, encirclement (blocking) in accordance with the list approved by the order of the Ministry for Reintegration of the Temporarily Occupied Territories of Ukraine;

decisions on the collection of housing and communal services for real estate, which is the place of permanent residence of such an individual and was destroyed or damaged as a result of military (combat) actions.
