Martial law and general mobilization continue in Ukraine due to Russian military aggression. Men liable for military service who receive subpoenas are subject to conscription.. Vladislav Yurchak, a lawyer at the T\u0026T Partners law firm, told Channel 24 what is the difference between a summons and a notice.

What is notification.

Notifications means that the person liable for military service was informed that he should be registered or clarify his credentials.

This does not necessarily translate into an indispensable mobilization, but may be due to the desire to clarify information and accounting, as well as the formation of a reserve.

What is the difference between notifications and subpoenas.

Notification is a document that is drawn up on the basis of an order from the head of the district (city) TCC and joint venture.

The notification may be addressed to local governments, heads of enterprises, institutions, organizations, including educational institutions, regardless of subordination and form of ownership. Here, the relevant persons are required to notify a specific list of citizens about their summons to the TCC and SP and to ensure their arrival at the TCC and SP within the time limits specified in the summonses, which, as a rule, are attached to such a notification..

“The notification is just a mechanism that the TCC and the joint venture can use to serve summonses to those liable for military service,” Yurchak said..

The agenda is a specific instruction that concerns a specific person and establishes an obligation for him to arrive at the TCC and the joint venture at a certain time:.

data refinement;

passing the military medical commission;

call for military service;

mobilization to a specific military unit (mobilization order).

The expert emphasized that, from the point of view of legal force, the notification does not oblige the persons liable for military service to take any action, however, receiving a summons as a result of the notification entails legal consequences..

If employers, heads of institutions, enterprises and organizations, as well as officials, if they fail to fulfill their duties established by the order of the head of the TCC and joint venture, may be held administratively liable under Article 210-1 of the Code of Administrative Offenses. The sanctions of the article provide for a fine from 1700 to 3400 hryvnia and from 3400 to 5100 hryvnia (for officials).
