Mobilization in Ukraine: can a person liable for military service receive a summons abroad

Due to the military invasion of the Russian Federation in Ukraine, general mobilization and martial law continue. During mobilization, men liable for military service from 18 to 60 years old who receive subpoenas are subject to conscription. Vladislav Yurchak, a lawyer at the T\u0026T Partners law firm, told Channel 24 whether Ukrainians abroad can receive a subpoena.

In Ukraine, at the end of December 2022, a new procedure for organizing and maintaining military records of conscripts, conscripts and reservists was approved.

In particular, the new procedure imposes a number of duties on the diplomatic institutions of Ukraine, namely:.

informing citizens of military age who do not have a deferment or are not exempt from conscription for fixed-term military service about the beginning of the next call-up of citizens of Ukraine for fixed-term military service;

facilitating the return of conscripts and reservists to Ukraine in case of mobilization and wartime (during a special period);

notification within seven days from the date of registration or deregistration of conscripts, conscripts and reservists by the relevant RTC and SP at their location on military registration;

maintain military records of conscripts, conscripts and reservists who are on temporary consular registration.



Yurchak noted that, according to the current legislation, representatives of diplomatic institutions are not entitled to issue any types of summonses and hand them over to citizens living abroad.

“Under the new procedure, the powers of diplomatic institutions are reduced solely to keeping records of those liable for military service and informing the relevant authorities in Ukraine about this, and therefore innovations in the legislation do not affect persons abroad in any way,” Yurchak explains..
