The Internet Association of Ukraine sent letters to the Antimonopoly Committee and a number of other institutions with a view to ending illegal demands on the part of PJSC "EC" Khersonoblenergo "with the access of telecommunication providers to power transmission supports using a compatible suspension network.

The letters say that PJSC "EC" Khersonoblenergo ", using its monopolistic (dominant) position in the market for access to the power transmission infrastructure, despite the decision of the Kherson territorial division of the AMCU, continues the practice of concluding cooperative agreements regarding the possibility of using supports for joint suspension lines of communication and requires the use of traverses at an overpriced.

These actions, according to the letter of InAU to the Antimonopoly Committee, contradict the requirements of the Law on Access to Construction, Transportation, Electricity for the Development of Telecommunications Networks, designed to regulate the relationship between providers and infrastructure owners.

- PJSC "EC" Khersonoblenergo ", using its monopoly (dominant) position in the market of services for access to infrastructure by providing for use of support of overhead lines for joint suspension of telecommunications networks in the territory of Kherson region, offers operators, telecommunications providers to enter into cooperation agreements regarding the possibility use of supports for joint suspension of communication lines, - the document says. - At the same time, the operator, the telecommunications provider should pay about UAH 300. for the service for the transfer of telecommunications networks to the fasteners (traverses), which were determined by the oblenergos. The specified service is not actually needed by operators, telecommunications providers and is not established by the Access Law.

However, the operator, the telecommunications provider is forced to fulfill such requirements of the owner of the power grid infrastructure (JSC "Khersonoblenergo"), since otherwise its telecommunications networks and equipment can be dismantled, which will lead to the termination of the provision of telecommunications services to consumers (subscribers).

Recall that in the Sumy region, the provider and the AMC managed to prove in court the monopoly position of the local oblenergos and oblige it to revise the tariffs for using one support to an economically sound level, in particular, by excluding from the calculation the wrongly included part of the costs of establishing support.
