In the Cherkasy region, the court examined the case of a man who was accused of intentionally evasion of mobilization. As a result, a citizen escaped responsibility.

The reason to justify the accused, the court recognized the violation of the warning procedure by the TCC. Details of the case are set out in the decision of the Derevsky District Court of the Cherkasy region, published in the Unified State Register of Courts.

A resident of the village of Draz appeared in court on suspicion of deliberate evasion of mobilization. The prosecution claimed that the man on July 10, 2022 informed about the need to arrive the next day to the territorial center of the acquisition for further referral to the military unit.

However, at a certain time, a citizen did not appear in the TCC - despite the lack of good reason, which caused a suspicion of suspicion of intentionally evasion of mobilization.

In court, the man said that he was going to fulfill the request for arrival in the TCC, but he misunderstood the message. From the TCC they called him on the evening of July 10, during the conversation he did not hear the appointed time (14:00).

The next morning, according to the man, they again called him from TCC and said that there was no need to come. No one in contact with a citizen again. The neighbor of the accused also spoke about the same in court.

The court drew attention to the fact that another date was indicated in the agenda handed by the man, which was not mentioned in the indictment. And he was informed about the need to arrive in the TCC on July 11 only by phone, which does not comply with the notification procedure specified by law. The fact of the call was not documented.

Based on the indicated, the court decided that there was no intent to evade mobilization in the actions of the man, and the state bodies did not ensure the observance of the call procedure.

Therefore, the court did not discover in the actions of the citizen of the criminal offense, so he recognized him innocent justified him. We will remind, earlier it became known that in the Vinnitsa region they sent a summons to a military man who died at the front. After publicizing, the TCC explained the possible reasons for how this could happen. They noted that the cause of the error was a technical failure in the Automated Obierig system, which generates the agenda based on the available databases.
