The Krasnoufim interdistrict prosecutor's office checked the enforcement of legislation on road safety when carrying passengers and luggage by road on suburban routes.
In accordance with the Federal Law "On Road Traffic Safety", legal entities and individual entrepreneurs carrying out activities related to the operation of vehicles must organize the work of drivers in accordance with traffic safety requirements; To observe the established mode of work and rest of drivers; Analyze and eliminate the causes of road traffic accidents and violations of traffic rules with the participation of their vehicles.
When summing up the work time of drivers, the duration of their daily (inter-shift) rest should be at least 12 hours, and the duration of daily work (shift) - can not exceed 10 hours.
In violation of these requirements, the duration of working hours for drivers of an individual entrepreneur was 13 hours or more. In this case, in the travel sheets there were no notes on the passage of pre-trip and post-trip medical examinations by drivers.
In addition, in violation of the requirements of labor legislation, a special assessment of working conditions in the workplace was not carried out in full and individual entrepreneurs did not provide drivers with special clothing and other personal protective equipment.
Based on the results of the inspection, the prosecutor's office initiated 3 administrative cases against 3 individual entrepreneurs. 3 items. 14.
2 of the Administrative Code of the Russian Federation (carrying out entrepreneurial activities in the field of transport in violation of the conditions stipulated by the license), upon the consideration of which 2 entrepreneurs were fined for a total of 20 thousand rubles, 1 businessman received a warning.
In connection with the violation of labor legislation, individual entrepreneurs are brought to administrative responsibility by h. 2, 4 art.. 27th. 1 of the Code of Administrative Offenses of the Russian Federation in the form of fines totaling 37 thousand rubles.
The actual elimination of violations in the organization of transport by public transport is under the control of the prosecutor's office.
