Before the major reform of legislation in the field of copyright, the main by-law regulating relations in this area was the resolution of the Cabinet of Ministers of Ukraine " 12. 2001 No. 1756. Both the old and new Orders provide for the possibility of state registration of a written work. According to the Law of Ukraine “On Copyright and Related Rights”, a composed work can include a collection, encyclopedia, anthology, etc..

According to the new Procedure, the applicant has the right to submit one application for a written work and receive one document of protection (certificate). In this part, the approach does not differ from the previously existing.

Let's give a more specific example. According to the new Procedure, the applicant has the right to submit one application for registration, for example, collections of literary works with illustrations as an independent object of copyright and receive one certificate of state registration of copyright, while paying one fee to the state.

In this case, a certificate of registration of copyright for a compiled work certifies the applicant’s rights to an object such as a collection, and not to each individual work included in this collection, since the work included in the collection is a separate object.

If the applicant is the subject of the right to all the works included in the composite work (for example, the applicant is the author of all the stories or poems included in the collection), then he can submit separate applications for each of the individual works (stories or poems) included in the composed work. To do this, he should fill out separate applications, and he will be able to receive the corresponding number of protection documents, for which he must pay the corresponding number of fees.
