Despite the war, pensions and other social benefits continue to be paid in Ukraine. If a person who received social benefits dies, the question arises of the further receipt of such payments by his relatives. Specialists of the Pension Fund of Ukraine (PFU) explained whether it is possible to receive social benefits of a deceased person by inheritance.

The PFC emphasized that, according to the Civil Code of Ukraine, inheritance is the transfer of rights and obligations (inheritance) from the deceased (testator) to other persons (heirs).

The composition of the inheritance includes the rights and obligations that belonged to the deceased person at the time of the opening of the inheritance, and did not cease as a result of his death..

“The rights and obligations that are inextricably linked directly with the person of the testator, in particular, the right to compensation for damage caused by injury or other damage to health, are not part of the inheritance,” the message says..

Thus, the heirs of a deceased person can only receive insurance payments in connection with temporary disability, injury or other damage to health that belonged to the insured person and were not received by him during his lifetime..

“It is these payments that are transferred to the family members of the victim, and in case of their absence, they are part of the inheritance,” the PFU stressed..

At the same time, the amount of insurance payments that were not paid to the injured person in a timely manner, due to the fault of the authorized management body or its territorial bodies, may also be included in the inheritance (in accordance with the law “On Compulsory State Social Insurance”).
