Economic Center CASE Ukraine announced the collection of signatures under a letter to the IMF mission, which is preparing a new program for Ukraine. The letter was published at.

It is noted that Ukrainian experts want to involve the IMF in the problem of presumption of guilt in tax administration in Ukraine.

" ) will include a list of conditions on the basis of which funding will be allocated. This is a very right moment to raise the issue of presumption of guilt in tax administration to a new level,"

Experts ask the IMF to publicly admit that the practice of using the presumption of guilt in tax administration is erroneous and needs to be revised.

"

The letter is planned to be sent to the IMF by the end of March. Collection of signatures will last until March 27.

Recall that in October 2022, a petition was registered on the website of the President on the need to introduce the right of a taxpayer (tax agent) to the presumption of innocence in the tax legislation of Ukraine.

" All procedures are set up in such a way that at every step the entrepreneur must prove that he did not intend evil,"

This is the ability to block tax invoices, and the ability to stop the work of the enterprise by checking - these are all elements of the system, which is based on the presumption of guilt of the taxpayer.

" And only if guilt is proven in court, the taxpayer (tax agent) will be punished in proportion to the violation committed. It's called the rule of law and the inevitability of punishment.. However, laws do not work in Ukraine,"

It is noteworthy that this appeal gained the required number of signatures and was considered by President Volodymyr Zelenskyy.

The Head of State instructed Prime Minister of Ukraine Dmytro Shmyhal to work out the issues raised in the electronic petition, including analyzing international experience in the relevant area, and take the necessary measures based on the results, including those aimed at strengthening the protection of taxpayers' rights in the practical application of legal acts.

However, as you might guess, for the five months that have passed since then, the results of the relevant work are still not known to society..

We also recall that according to the World Bank Rule of Law Index, compiled as of 2020, the judicial and law enforcement system in Ukraine has not even come close to the level that existed in Poland, Slovakia and the Baltic countries back in the early 90s.

It is also interesting that back in 2010, the current chairman of the Verkhovna Rada of Ukraine Committee on Finance, Tax and Customs Policy, Danil Getmantsev, advocated the introduction of the principle of the presumption of innocence of the taxpayer. With an article by Getmantsev - \? " U.A..
