The Constitutional Court of Ukraine received an opinion on the unconstitutionality of paragraph 1 of the first part of Article 40 of the Law of Ukraine " As follows from the text of the document published on the website of the Constitutional Court, the submission was initiated by the Plenum of the Supreme Court, held on March 3, 2023.

The submission notes that the law “On Compulsory State Social Insurance”, which came into force on January 1, 2023, set out in a completely new edition, changed, in comparison with the law of 1999, in the direction of worsening the provision on the termination of insurance payments and the provision of social.

So, if the previous version of the law provided that such payments cease in the event of a person leaving for permanent residence abroad (unless otherwise provided by international treaties, to which Ukraine agreed)), the new version provides that a person is deprived of such payments only if.

Currently said constitutional submission is distributed to the rapporteur judge.

Recall that the plenum of the Supreme Court is a collegiate body, which includes all judges of the Supreme Court.

In February, it became known that the Ministry of Finance is preparing a methodology that provides for the revision of the right to receive pension payments and life support if a person has left for permanent residence abroad. These provisions apply to pensioners, as well as retired judges who receive a life allowance instead of a pension..

In support of this initiative, the draft order contains a reference in part three of Article 9 of the Law of Ukraine " At the same time, this article deals only with the procedure for conducting inspections..

In pursuance of what legislative norms the Cabinet of Ministers is going to evaluate the legality of paying pensions and salaries for citizens living abroad, there is no reference in the order of sending.

At the same time, the government approved bill No. 9004, which gives the Pension Fund access to information about citizens crossing the borders of Ukraine, as well as about their entry into the zone of occupation or stay in the occupied territory. No explanation is given in the draft why the Pension Fund needs such information.. The bill has already been submitted for consideration by deputies.
