From now on, employees and employers, by mutual agreement, will be able to conclude employment contracts, in which they themselves will determine most of the conditions for cooperation.. This is provided for by the law No. 5371 adopted by the Verkhovna Rada on the modernization of labor relations for business.

As follows from the commentary to the law of the head of the Servant of the People party, Elena Shulyak, the deputies consider the so-called "

" In the conditions of modern economic realities, the extremely rigid regulation of labor relations contradicts the principles of market self-regulation and personnel management, which does not meet the current needs of the labor market and creates numerous unreasonable bureaucratic barriers both for the self-realization of employees and for increasing the competitiveness of employers,"

Now employees and employers, by mutual agreement, will be able to conclude employment contracts, in which they themselves will determine most of the terms of cooperation.

" It will also allow increasing wages for employees and establishing flexible working conditions,"

Thus, the law provides:.

introduction of a simplified regime for the regulation of labor relations for certain categories of workers and for small and medium-sized businesses;

implementation of the principle of freedom of labor and freedom of labor contract;

reducing the bureaucratic burden on business entities - employers;

preservation of the basic universally recognized labor rights and guarantees of employees.

In particular:.

a contractual regime for regulating labor relations is introduced with the possibility, at its own discretion and with the consent of the parties, to include in a written labor contract provisions on the emergence and termination of labor relations, labor standards, wages, allowances, additional payments, bonuses, remuneration and other incentive, compensation and guarantee payments;

such a contractual regime is proposed for interaction between an employee and an employer - a representative of a small or medium-sized business (the number of employees for which per year is not more than 250 people; and the amount of the employee's salary is more than 8 minutes of salary per month);

The contractual regime does not apply to legal entities of public law.

As recently as July 3, the Verkhovna Rada made significant changes to the legislation on labor relations, which affected holidays, part-time jobs, dismissal, calculation of seniority, etc..

By the way, as of today, the civil service law no longer protects the labor rights of civil servants.. Now another law will have priority in regulating labor relations with civil servants.
