Today, labor reform, as well as during previous attempts to reform labor legislation that already took place in Ukraine in 2003, 2009, 2012, 2015 and 2020, is at risk, writes Lubomyr Chorniy in the article "

Trade unions are the main opponent of the liberalization of the regulation of labor relations in Ukraine - they even refused to participate in the working group, which, on the basis of the Verkhovna Rada Committee on Social Policy and Protection of Veterans' Rights, finalized bill No. 5371 until the second reading.

The interest of trade unions is understandable - to maintain their influence and approach to the dominance of the collective agreement in the field of regulation of labor relations and the resolution of labor disputes. As well as the dominance of approaches promoted by the International Labor Organization and implemented in Ukraine in the toughest form: without taking into account the modern transformation of the labor market and the growing role of small and medium-sized businesses in market economies.

“Trade unions continue, and this is understandable, to insist on tools for protecting the rights of workers, which are inherent in large enterprises, but are completely deadly for all micro and small, as well as a considerable part of medium-sized businesses,” the author notes..

With such approaches, a significant amount of employee rights is delegated to a phantom labor collective, and in rare cases, also to trade unions.. In practice, this deprives the employee of economic independence and real opportunities for legal protection, forces the employer to maintain burdensome personnel documentation or look for an alternative to the legal involvement of hired labor (for example, by entering into civil law contracts with sole proprietorship).



Thus, the state must maintain the existence of a cumbersome and inefficient system of state control in the sphere of labor, which, rather, leads to corruption and the washing out of employer resources than provides real protection to the employee..
