New Year's gifts from the deputies are special, because it is impossible to refuse them. These gifts are laws. The Laboratory of Legislative Initiatives has prepared an overview of laws that will affect the life of Ukraine and Ukrainians in the new year, 2022. In total, 48 new laws will come into force in 2022 (this list includes laws already signed by the president and published in the relevant official publications as of 26. 12. 2021 year. Considering that several more laws lie on the signature of the president, in the end the number of gifts from deputies for 2022. can only increase). They cover a wide range of issues - from baby food to the resistance movement in the event of large-scale aggression..

Some of these laws have already entered into force, but will come into force in 2022, and some will come into force and will come into force in 2022.. What does this mean? The law may enter into force, but, in fact, does not work. For the law to work fully, it is necessary that the government develop and adopt by-laws (RLA). The law may establish a general rule that a body, for example, the Central Executive Body, which ensures the formation of state policy in the field of inland waterway transport, develops and approves the rules of navigation on inland waterways.. But the law will not establish exactly how the ship should turn, other rules will not be detailed.. These more specific rules are set by the executive authorities.. It would be logical if, along with the general rules, specific. But for many laws this is not the case.. First, for example, from January 1, 2022, general rules (law) come into force, and then, for example, six months later, that is, until July 1, 2022, the government must develop specific rules (for example, order or regulation). And although the general rules should have been in effect already from January 1, in fact, they will be able to work only from July 1. Usually, the date of introduction of specific rules (introduction into force or the obligation of the government to develop legal regulations) is defined as the date by which these regulations should be developed.. If the government must develop a legal regulation within six months from the date of entry into force, then the final date is July 1, although this can be done before May 23. Further, at the beginning of each paragraph, exactly such a date is indicated - the deadline by which the government must develop its legal regulations, that is, the date from which the law will be able to fully earn.

The review does not include international agreements (ratifications), the state budget and amendments to it.

Part one.

January 1, 2022. Help for children with serious illnesses.

(On amendments to Article 18-7 of the Law of Ukraine "

This law applies to children with severe perinatal lesions of the nervous system, severe congenital malformations, rare orphan diseases, oncological, oncohematological diseases, cerebral palsy, severe mental disorders, type I diabetes mellitus (insulin-dependent), acute or chronic kidney disease IV degree; children who have received serious injuries, who need organ transplants, who require palliative care, who have not been diagnosed with disabilities. The amount of aid to such groups of children is changing. Previously, they received monthly assistance in the amount of the subsistence level for persons who have lost their ability to work (UAH 1,854 in 2021); according to the adopted law, these categories of children will receive monthly assistance in the amount of two living wages established for children of the corresponding age (as of December 1, 2021. it is 4200-5236 UAH).

January 1, 2022. Cancellation of consular fees for vulnerable categories of citizens.

(On amendments to some laws of Ukraine on the provision of benefits to certain categories of citizens of Ukraine who apply for consular actions No. 1666-IX).

This law exempts some vulnerable categories from paying consular fees when performing notarial acts in diplomatic missions and consular offices of Ukraine. Persons affected by the Chernobyl disaster, classified in categories 1 and 2, are exempted from this fee.; persons with disabilities of I and II groups, children with disabilities or their representatives; orphans, children deprived of parental care and their representatives. In addition, if the aforementioned persons have lost their passport, they will not have to pay the consular fee for issuing a new passport.. The same rules apply to children under the age of sixteen.. That is, if your child's passport is lost on an international trip, you do not need to pay for its registration in diplomatic institutions of Ukraine.

January 1, 2022. National resistance.

(On the Foundations of National Resistance No. 1702-IX).

The law is quite relevant in the context of modern safe calls. The components of national resistance are territorial defense, resistance movement and preparation of Ukrainian citizens for national resistance. If Russia launches a full-scale invasion of Ukraine, these components of resistance should inflict irreparable losses on the aggressor and force them to stop the invasion.. Territorial defense should play the main role in the action of resistance. The law describes which authorities and how exactly should organize territorial defense, resistance movement and national resistance, citizens should pay attention to the following:.

The basis of resistance is combined arms training, consisting of initial and basic military training. Basic military training is received in schools, in fact it is something similar to the former pre-conscription training or the subject of " Basic training is organized by the Ministry of Defense and concerns adults, it includes the conduct of periodic training camps, classes, courses. This does not apply to citizens serving in the army or law enforcement.

Volunteer formations of the territorial community. These are paramilitaries that must take part in ensuring territorial defense.. Detailed rules for the formation and operation of volunteer groups must be determined by the government. These formations may include citizens of Ukraine who have undergone medical, professional and psychological selection and signed a territorial defense volunteer contract.. It is assumed that the basis of these formations will be those who served in the army or law enforcement agencies, but other citizens can also be included in these formations if they take the oath.. Members of volunteer formations can use their own hunting weapons to perform tasks (although they are also provided with the issue of weapons). Members of volunteer groups cannot be affiliated with political parties.

Consequently, the citizens of Ukraine have another opportunity to join the defense of our state: they will be able to sign a contract and, with arms in hand, defend their own city or village..

January 1, 2022. Increase in the number of military personnel.

(On amendments to Article 1 of the Law of Ukraine "

The Law " In addition to volunteers, it will include military units of the Territorial Defense Forces of the Armed Forces of Ukraine, and one should not forget about the new headquarters.. Therefore, it is planned to increase the maximum number of the Armed Forces of Ukraine from 250,000 people (of which 204,000 are military personnel) to 261,000 people (of which 215,000 are military personnel). That is, there was an increase of 11 thousand military personnel who are planned to be involved in territorial defense.

January 1, 2022. Transfer of ownership of land.

(On amendments to some legislative acts of Ukraine regarding the transfer of rights to a land plot in connection with the transfer of rights to an immovable property, placed on it No. 1720-IX).

The content of this law boils down to the fact that a land plot and a house (real estate) located on this land plot must be sold only together. That is, it will not be possible to sell / buy only land (without a house) or only a house (without land) - they will definitely come in a set. The reason for the adoption of such a law is the inconsistency of the norms of the Land and Civil Codes with real practice..

January 2, 2022. Water use.

(On amendments to article 42 of the Water Code of Ukraine on clarification of the list of primary water users No. 1726-IX).

For the vast majority of Ukrainians, the introduction of this law will change little.. The changes will affect primary water users - those who have their own water intake facilities and appropriate equipment for water intake, as well as those receiving water from irrigation and drainage systems, reservoirs, ponds, water management systems, canals and water pipes (water pipelines) of inter-basin and intra-basin redistribution of water resources. Primary water users will have to conclude contracts with enterprises providing water supply to canals and reservoirs. This will help to fill the budgets of the State Water Agency canal management at the expense of large enterprises that consume a lot of water, so that later these funds can be spent on modernizing equipment and in the future to ensure uninterrupted water supply..

January 13, 2022. Water transport.

(On inland waterway transport No. 1054-IX).

Another big law of 123 pages, which cannot be described in detail in a few paragraphs.

This law should revive navigation on large rivers, in particular the Dnieper. Consequently, the number of road freight traffic should decrease (t. less funds will have to be allocated for road repairs) and an increase in the number of jobs in industries that carry out river transport.

The law should also allow obtaining funds (through the creation of a specialized fund) for the repair of river infrastructure, in particular, shipping locks..

River passenger transportation should also intensify.

Attention to this law should be paid to the owners of water transport - for example, small vessels (yachts, boats) or jet skis, because the law establishes the rules of navigation, technical requirements for ships, the issue of their registration, requirements for the qualifications of captains, etc..

But there are also comments to the law: some experts speak of providing tax advantages to foreign ships over Ukrainian ones, and a more practical warning is the permission to discharge wastewater from ships into rivers (which are the main source of drinking water).

Therefore, if you are the owner of water transport, we advise you to read the law, if not, you just have to wait for the economic recovery of Ukraine and hope that the water in the rivers will not be dirty..

January 16, 2022. Electronic communications.

(On electronic communications No. 1089-IX).

This law of 128 articles on 222 pages describes in detail the rules for the functioning of electronic communications, therefore, we will focus on the most important for the majority of citizens - users of electronic communication services - provisions. The law proposes the following changes:.

Reducing spam (deliberate mass mailing of electronic, text and / or multimedia messages without the subscriber's consent to receive information) and the mandatory possibility of the subscriber's refusal to send.

An electronic platform is being introduced, on which there will be information about all service providers, in particular their list, availability of licenses, availability.

The ability to choose certain types of services (not included in the package).

The right for the subscriber to receive comprehensive and clear information about the terms of the contract (in particular, information about the cost of use, maintenance and the minimum, average and maximum speed of communication or the Internet).

Suppliers will pay increased fines for violations of user rights.

The Communications Services Regulator will have the right to obtain financial and restricted information about subscribers from electronic communications providers.

Electronic communications may be limited in the event of a state of emergency and martial law and in the area of \u200b\u200ban anti-terrorist operation.

Service users will be able to complain about providers to the regulator, which must consider the complaint within two months. It will be possible to settle a dispute between the provider and the user of the service out of court (although in case of significant disagreements, you may still have to go to court).

February 1, 2022. Social protection of Chernobyl victims.

(On Amendments to the Law of Ukraine "

The law increases the size of pensions for liquidators and persons affected by the Chernobyl disaster. For children with disabilities and persons with disabilities of the third category, the minimum pension will be 3700 UAH, for the second category - 4800 UAH, for the first category - 6000 UAH. In addition, an additional pension for harm caused to health and monthly compensation to families for the loss of a breadwinner due to the Chernobyl disaster are paid in full, regardless of salary, pension or other income.. Also, the minimum amount of general pension payments is established with reference to the average salary.. For the first category it is 100%, for the second category - 80%, for the third category - 60% of the average salary in Ukraine. That is, if the total amount of pension payments does not reach the aforementioned level, the state pays the difference.

February 1, 2022. Unimpeded access of persons with disabilities to their own housing.

(On amendments to some legislative acts of Ukraine on social protection of persons with disabilities No. 1665-IX).

Housing for persons with disabilities must be adapted for their unhindered access (this must be ensured by local governments or organizations in charge of the housing stock). If the housing of a person with a disability does not have easy access for such a person and such access cannot be provided, then the housing should be replaced. Such a replacement should be provided by local governments.. New housing must meet the requirements for unimpeded access. This law should make life easier for people with disabilities. The only concern is its implementation, namely, the willingness and resources of local governments to ensure unhindered access for persons with disabilities to their own homes..

February 20, 2022. Simplification of electrical connections.

(On amendments to some legislative acts of Ukraine on simplifying the procedure for connecting to power grids No. 1657-IX).

The law aims to simplify the procedure for connecting to power grids, which, in turn, should facilitate doing business (this law applies primarily to entrepreneurs) and increase the investment attractiveness of Ukraine. This law has already entered into force, but in reality it will begin to operate only in 2022, because the government must bring its by-laws into compliance and develop software.. In addition, some of the provisions will take effect from 2023.. The bill proposes the following main innovations:.

The procedure for providing land for the laying of electric lines is simplified, the development and approval of appropriate land management and project documentation, in particular, the principle of tacit consent is introduced when approving land management projects for the construction of electrical lines.

Creation of a " All documents, messages and responses can be submitted electronically.

Changes to the State Land Cadastre should now take place within one day.

Many permits, procedures and approvals have been canceled, in particular regarding geodetic works, environmental impact assessments, violations of landscaping elements, etc.. According to the authors of the bill, such permits and procedures are unnecessary bureaucracy, overgrown with corruption schemes..

Connecting to power grids, therefore, should become faster, simpler and clearer..

April 1, 2022. Import of electric vehicles without VAT and benefits for electric vehicle manufacturers.

(On amendments to section XX "

Ukrainians are unlikely to feel the results of the adoption of this law in 2022, because the law is aimed primarily at stimulating production. The law provides for exemption (for a period of 15 years) from VAT and income tax for enterprises producing electric motors, batteries for electric vehicles, chargers for them. VAT is also not necessary to pay when importing equipment for the production of electric vehicles. Such measures should stimulate the production of electric vehicles or its components, as well as reduce the cost. This, in turn, should reduce the price of electric vehicles.. Therefore, we can expect that in 5-10 years the number of electric buses will increase on Ukrainian roads, and perhaps even Ukrainian light electric vehicles will appear..

Changes that will affect the citizens of Ukraine already in 2022 - the extension of the VAT exemption period for the import of electric vehicles until 2026. Additionally, until 2026, the import of vehicles powered exclusively by compressed natural gas methane, liquefied natural gas methane or biogas was exempted from VAT.. Therefore, if you do not believe in the prospects of creating a Ukrainian Tesla, then you have another five years to buy an electric car of foreign production at reduced prices..

April 1, 2022. Preferential import of equipment for the production of electric vehicles.

(On amending paragraph 4 of Section XXI "

This law complements the previous one, but it is aimed only at enterprises. To stimulate the creation of production of electric vehicles, the relevant enterprises are exempted from paying import duties when importing equipment that is used to produce:.

electric transport;

vehicles powered by compressed natural gas methane, liquefied natural gas methane or biogas;

carriages for trams and metro.

Ukrainians are unlikely to feel the effect of this law in 2022. (if we do not take into account the possible creation of new jobs), the effect may occur in 5-10 years, when a significant part of transport (primarily passenger) will start working on electricity.

April 8, 2022. Discrimination in advertising.

(On Amendments to the Law of Ukraine "

This law prohibits placing advertisements that are discriminatory on the basis of a person's origin, social and property status, race and nationality, gender, education, political views, attitude to religion, linguistic characteristics, nature and occupation, place of residence.. It will also be prohibited to post advertisements that are discriminatory on the basis of gender or contain stereotypical male and female roles, in particular the use of images of a sexual nature.. For violations, a fine of 10 minimum wages is provided. Now Ukrainians will see less naked bodies in advertisements and will not be deceived by the disguise of low-quality goods with the charms of female or male bodies..

April 12, 2022. Science parks.

(On amendments to some laws of Ukraine regarding the revitalization and development of scientific parks No. 1714-IX).

The said law is also unlikely to affect the majority of citizens.. Science parks are economic societies, among the founders of which are institutions of higher education or scientific institutions.. They are allowed to attract loans and grants, and their founders can be foreign legal entities. Another innovation - now science parks do not need approval from the executive branch. Science parks will also be able to rent premises in universities and research institutions on preferential terms. Will Science Parks Help Improve the State of Ukrainian Science - Time Will Show.

May 7, 2022. Oligarchs.

(On the prevention of threats to national security associated with the excessive influence of persons with significant economic and political weight in public life (oligarchs) No. 1780-IX).

A loud law, which, as the president promises, should help him in his difficult fight against the oligarchs. Will such an innovation really help in this fight? The main provisions of the law are reduced to:.

Definition of the concept of " Enters the NSDC into this register (actually determining who is an oligarch and who is not). NSDC also excludes persons from this register. It should be remembered that the NSDC is a body completely controlled by the president..

Oligarchs are prohibited from: financing parties, rallies, demonstrations and buying objects of large privatization.

Oligarchs must file property declarations, as civil servants do now..

Civil servants must submit declarations of contact with oligarchs.

How exactly these innovations will help to overcome the corrupt influence of the oligarchs on political processes, and whether they will help at all, is difficult to say now..

May 13, 2022. Children food.

(On amendments to some legislative acts of Ukraine regarding bringing the legislation of Ukraine in the field of providing baby food in accordance with the requirements of the legislation of the European Union No. 1822-IX).

The main innovations regarding baby food:.

Increased requirements and control for baby food, adaptation to European standards, which should increase the safety of baby food. This will be done by clarifying the terminology and requirements for the composition of baby food, introducing fines for violating these requirements for manufacturers.

Banning advertising of infant formula on television, advertising will only be permitted in specialized publications. Such a ban should limit the influence of advertising on mothers' decisions to stop breastfeeding..

Banning Gluten Free Information on Baby Food Products. This way consumers will not be misled, since the use of gluten in baby food is prohibited at all..

Determination of the list of mandatory additional information about baby food, which must be indicated on the packaging: the age of the child from which this food is allowed, the amount of minerals, vitamins, the amount of choline, inositol, carnitine, etc..

Now the popular "

August 1, 2022. Payment systems.

(On payment services No. 1591-IX).

This new law also introduces many innovations for the market of banks and non-bank financial institutions.. But most of these changes relate to internal banking systems and procedures.. Users of payment services should pay attention to the following:.

There will be significantly more opportunities for payments, transfers, opening accounts and payment cards. Now not only banks, but also non-banking institutions will have this right.. For example, the post and electronic money institutions (PayPal, WebMone) received the right to provide payment services (transfers, cash withdrawals, opening / closing accounts). Accordingly, Ukrainians will be able to carry out such operations in more institutions..

The implementation of the Open banking system provides that financial service providers (banks and other institutions where accounts are opened) must provide constant real-time access to the accounts of their users, banks and other payment service providers.. Such access should only be provided with the consent of the users..

Tightening authentication requirements and increasing accountability for cyber fraud. This should protect users, as the circle of potential fraudsters and their opportunities have grown.

In general, this law, like many others, follows the path - more services and opportunities in exchange for more openness and more data provided.. To what extent this strategy is correct and justified, each Ukrainian must decide for himself.

August 6, 2023. Dangerous objects.

(On amendments to some legislative acts of Ukraine on high-risk facilities No. 1686-IX).

Unlike other laws, this law, although it comes into force in August 2022. , but will start to operate fully only in the middle of 2023, because the government has one year to develop by-laws to implement this law. For most citizens, the law concerns only indirectly: it should reduce the risks of accidents at hazardous facilities and thus increase the safety of citizens. For this, the law provides for: a procedure for the identification of hazardous facilities, their assignment to 1, 2 or 3 hazard class, the obligation to report on the presence of hazardous facilities, the development of plans for the localization and elimination of accidents. For the most hazardous facilities, emergency response plans must be approved by local governments.

Social benefits, tax and customs cut cuts, fighting oligarchs, and simplifying power grid connections seem like good gifts.. However, do not forget that there are good gifts, and there are not very good ones.. In order not to spoil the first impression, this part included mostly positive or at least optimistic laws.. In the second part, not everything will be so good: we will talk about cash registers for individual entrepreneurs, new land taxes, restrictions on the sale of drugs, an increase in the cost of electronic services and alcohol.

After reading an overview of these 19 laws, you are already on the path of the king of the jungle 2022. But, judging by the astral horoscope, in order to navigate the new realities of 2022 like a real tiger, you should read the second part, which will cover 29 laws.
