Supreme Court of Austria will consider the cassation appeal of the lawyers of the owner of Group DF Corporation Dmitry Firtash to the verdict of the Court of Appeal, which allowed the extradition of the Ukrainian oligarch to the United States.
"The Supreme Court decided to suspend the extradition of Mr. Firtash before consideration of his appeal," said in a statement released on Tuesday, December 26, by lawyer Lanny J. Davis from the American law company Davis Goldberg Galper PLLC, which represents the interests of Firtash in court.
52-year-old billionaire Dmitry Firtash is wanted in the US on suspicion of giving bribes, and in Spain - in money laundering. In February, the highest land court in Vienna refused to extradite Firtash to the US, citing a pledge of 125 million euros paid by the oligarch and his commitment not to leave Austria. In late August, the land court in Vienna refused to extradite Firtash to Spain, saying that the court in Barcelona presented too vague evidence of crimes attributed to the oligarch. On December 19, the Supreme Court of Justice in Vienna rejected the complaint of the prosecutor's office against the decision of the land court.
Dmitry Firtash, who made a fortune thanks to gas trading, was considered an important ally of former President Viktor Yanukovych. After the overthrow of Yanukovych, he first fled to Russia, and from there to Austria, where he was detained in 2014 on the basis of an American warrant of arrest. The litigation that began at that time is still going on.
As you know, Dmitry Firtash appealed to the Austrian Constitutional Court to avoid extradition to the United States, where he faces up to 50 years in prison and confiscation of all assets. In the US, he is accused of trying to get permission for titanium mining in India, using bribes worth a total of $ 18.
5 million, and using US accounts and servers to transfer bribes to Indian officials.
On February 21, the Austrian Court of Appeals authorized Firtash's extradition to the United States. The final decision on extradition will be made by the Federal Minister of Justice of Austria.
At the same time, the Austrian lawyer of the Ukrainian oligarch confirmed his detention immediately after the court session and announced his intention to appeal this decision to the Supreme Court of Austria and the European Court of Human Rights.
