Salary deductions: what percentage can an employer withhold?

In Ukraine, labor relations between employee and employer are regulated by relevant legislation. There are cases when an employer, for one reason or another, withholds certain amounts of funds from an employee’s salary. Specialists from the South-Eastern Interregional Department of the State Labor Service told us how much deductions from wages an employer can withhold.

Derzhpratsi noted that in accordance with Article 128 of the Labor Code, deductions from wages, after taxes, usually cannot exceed 20%, and in cases provided for by law (when collecting alimony; compensation for damage caused by injury, other damage to health or death, as well as loss of a breadwinner; compensation for losses caused by crime; if persons who buy goods in installments make payments according to writs of execution) - 50% of wages.



“According to several executive documents, the employee must have at least 50% of his earnings, with the exception of alimony for minor children (up to 70%),” the message says..

Experts added that the restrictions established by. 2 tbsp. 128 of the Labor Code do not apply to deductions from wages when serving a sentence in the form of correctional labor and when collecting alimony for minor children.

“In these cases, the amount of deductions from wages cannot exceed 70%,” the message says..
