General mobilization and martial law continue in Ukraine. During this period, men liable for military service who receive summons are subject to mobilization. But some may get a reservation. Managing partner of the Elena Khomenko AB, Elena Khomenko, in an interview with Ukrainian Radio, told what changes have occurred in the booking rules.

What innovations will apply to employee bookings from February 1.
Khomenko explained that the status of criticality for enterprises and the criteria for assessing criticality do not change.
“The minimum acceptable wage threshold is changing for all workers working in the critical enterprise or defense sector. The minimum wage for an employee previously had to be at least 20,000 hryvnia, but today it is 21,617 hryvnia. This is the minimum wage threshold that allows you to book an employee at the enterprise,” she said.
Among the innovations, the lawyer also named a reduction in bureaucratization and acceleration of all processes.
“If previously the application was considered within three days, today this period has been reduced to 24 hours. The criticality status can be displayed both before the completion of mobilization, and for a period of three months, depending on the status of the enterprise,"
The expert explained that the changes also affected booking updates.
“If previously it was possible to re-apply for a reservation only five days after the refusal, now this can be done immediately. Booking through Diyu makes it possible to be enrolled in a special account in the Oberig system,” she said.

Does the employee need to have paper documents confirming the booking?.
According to Khomenko, if an employee’s reservation in the system expires today and there are emergency shutdowns that do not allow the employer to restore data in the system, one should not forget about the possibility of exchanging paper data.
" You should have not only an extract from the “Reserve” system with updated data, but also a certificate of employment at this enterprise and documents confirming the criticality status of the enterprise,” she explained.
The lawyer noted that if the status of a booked person disappears in the system, this will entail legal consequences in the future. The first consequence is the removal of this status in the Reserve application.
“If the reservation suddenly disappears due to force majeure during the updating of data and passing the Military Military Commission, a person liable for military service can be called up at any time by any TCC on the territory of Ukraine. These risks are worth remembering. Typically, the period for reflection in electronic registers ranges from one day to three days,” she said.
Which enterprises qualify for critical infrastructure status?.
The expert explained that, first of all, these are defense industry enterprises.
" There should be no debt on unified social tax and taxes. There are also regional indicators. Each region determines them personally for itself,” the lawyer explained..
Khomenko added that all enterprises aimed at the defense sector receive full criticality and the opportunity to reserve 100% of their workers.
“Regarding the private sphere, they are very careful in checking all the criteria that must be met to receive criticality status. The period for which it can become critical depends on the enterprise,” she concluded..
