“Derzhpratsi” noted that Art.. 47 of the Labor Code of Ukraine obliges the employer, on the day of the employee’s dismissal, to give him a copy of the order or instruction on dismissal, a written notice of the amounts accrued and paid to him upon dismissal and to make settlements with him within the time limits specified in Article 116 of the Code, as well as, at the request of the employee, to make appropriate entries about the dismissal in the work book, if it is kept by the employee.
So, according to paragraph 4. 1 of the Instructions on the procedure for maintaining work books of employees, approved by order of the Ministry of Labor, the Ministry of Justice, the Ministry of Social Protection of the Population, the employer or the body authorized by it on the day of dismissal must issue the employee a work book with the corresponding entry made in it.
“If the issuance of a work book is delayed due to the fault of the employer, the employee is paid the average salary for the entire period of forced absence. In this case, the day of dismissal is considered to be the day the work book is issued.. An order is issued about the new day of dismissal and an entry is made in the employee’s work book.. A previously made entry about the day of dismissal is invalidated in the manner prescribed by paragraph 2. 10 of the mentioned Instructions,"
