Topchiy explained that according to the decision of the KMU No. 600 of 30. 05. 2023 Compensation for destroyed real estate objects is provided to its recipients through Oshchadbank JSC, in which the executor of the program opens an account.
“To provide compensation at the expense of the funds provided for by the second paragraph of paragraph 3 of this Procedure, the executor of the program opens up a separate account in Oshchadbank JSC, to which the mininfrastructure transfers funds to the executor of the program,” he said.
According to the expert, the indicated restriction concerns the relationship of the Contractor of the Program and the Mininfrastructure, and not the relationship of the Contractor of the Program and the Seller of the Housing.
“In accordance with the indicated resolution, the executor of the program transfers funds to the accounts of housing sellers specified in the contract on the purchase of housing, according to the list formed by means of the register of damaged and destroyed property on the basis of the information specified in subparagraph 2 of paragraph 58 of this Procedure and information on the transfer of ownership of housing, the acquisition of which is carried out in accordance with this Procedure..
The lawyer added that the legislation established that the transfer is made to the accounts of housing sellers specified in the contract for the purchase of housing.
“Therefore, according to the content of the law, such funds can be transferred to any bank account of the seller. But when transferring funds to the account of another bank, there may be banking commissions and this may be a problem, ”the Topchny summarized.
