Salary payment terms: can the employer change them during martial law?

In Ukraine, labor relations between employee and employer are regulated by relevant legislation. Even during martial law in Ukraine, the provisions of the law “On remuneration” continue to apply.. Specialists from the south-eastern interregional department of the civil service on labor issues told whether an employer during a war can change the terms of payment of wages.

The State Duma emphasized that the norms of Article 115 of the Labor Code of Ukraine and Article 24 of the Law “On Remuneration” continue to apply during martial law, therefore employers must comply with the same terms for payment of wages as in peacetime.



“Wages must be paid to employees regularly on working days within the terms established by the collective agreement or a regulatory act of the employer, agreed upon with the elected body of the primary trade union organization or other body authorized to represent the labor collective (and in the absence of such bodies - by representatives elected and authorized).

Experts emphasized that Article 10 of the law “On the organization of labor relations under martial law” obliges the employer to take all possible measures to ensure the realization of the right of employees to receive their wages on time.
