Mobilization in Ukraine: when will the military be able to leave service?

Due to the war started by the Russian Federation, martial law and general mobilization continue in Ukraine. Men liable for military service from 18 to 60 years old are subject to conscription. Recently the Verkhovna Rada adopted a bill on mobilization. The document contains norms regarding active military personnel. The publication Army Inform explained the reasons for leaving the service.

What may be the reasons for dismissal from service?.

The adopted document does not stipulate the possibility of resigning after 36 months of continuous service by decision of the Supreme Commander-in-Chief Headquarters. This provision was removed literally a few days before the vote.. But issues of demobilization and rotation should be included in a separate bill.

In general, there are more reasons for dismissal from service:.

if you have a disability;

in connection with the release from captivity;

in connection with staff reductions or organizational measures - if it is impossible to use them in the service (for senior officers);

in connection with the election as a people's deputy of Ukraine, deputy of the Verkhovna Rada of the Autonomous Republic of Crimea;

in connection with the appointment (election) to the position of judge, judge of the Constitutional Court of Ukraine, member of the High Council of Justice, member of the High Qualification Commission of Judges of Ukraine, Chairman of the Service of Disciplinary Inspectors of the High Council of Justice, his deputy, disciplinary inspector of the High Council of Justice;

for family reasons or other valid reasons.

The bill also separately stipulates family circumstances and other valid reasons for dismissal:.

female military personnel - due to pregnancy;

military personnel on parental leave until the child reaches the age of three, as well as if the child needs home care for a duration determined in a medical report, but no more than until he reaches the age of six;

one of the spouses, both of whom are serving in the military and have a child(ren) under the age of 18;

military personnel who support three or more children under the age of 18, except for those who have arrears in child support payments, the total amount of which exceeds the amount of payments for three months;

military personnel with a child (children) under the age of 18, if the second parent of such child (children) has died, been deprived of parental rights, declared missing or missing, declared dead;

military personnel who are adoptive parents who support children, at the time of adoption were orphans or children deprived of parental care, guardians, trustees, foster parents, parent-educators who support orphans or children deprived of parental care,;

military personnel who are dependent on a child with a disability under the age of 18;

military personnel who support an adult child who is a person with a disability of group I or II;

military personnel raising a child with severe perinatal lesions of the nervous system, severe congenital malformations, rare orphan diseases, cancer, oncohematological diseases, cerebral palsy, severe mental disorders, diabetes mellitus type I (insulin-dependent IV), acute degree, a child who has been seriously injured;

military personnel who need to provide constant care for a family member of the first or second degree of kinship (subject to the absence of family members of the first degree of kinship or their physical inability), who is a person with a disability of group I;

military personnel who need to provide constant care for a family member of the first degree of kinship (no more than one), who is a person with a group II disability, are engaged in constant care for her, in the absence of other persons who can provide such constant care;

military personnel who need to provide guardianship over a person declared incompetent by a court, provided that such a person is not under guardianship (guardianship) by other persons;

military personnel in the event that their close relatives died or went missing while directly participating in an anti-terrorist operation, implementing measures to ensure national security and defense, repelling and deterring the armed aggression of the Russian Federation in the Donetsk and Lugansk regions, as well as ensuring national security and defense,.

This document partially removes the difference between contract soldiers and mobilized soldiers in terms of dismissal from service. After all, now those mobilized have more such reasons.
