Mobilization in Ukraine: can TCC workers detain people on the street

Due to the full-scale invasion of the Russian Federation, general mobilization and martial law continue in Ukraine. Men liable for military service aged 18 to 60 who receive summons are subject to mobilization.

The Commissioner of the Verkhovna Rada of Ukraine for Human Rights Dmitry Lubinets told Suspilny whether employees of territorial recruitment and social support centers (TCC SP) can detain Ukrainians on the street.

Lubinets stressed that such actions are nonsense.

" Can not. This is nonsense. Who benefits from this Army? No. Citizens of Ukraine who are afraid to go out? No,"

The Commissioner for Human Rights noted that an example of the correct behavior of the TCC in conditions where they have a list of people evading mobilization are the actions of the TCC in the Poltava region, where the military turned to the National Police with lists of people who should appear at the TCC, but did not.

“And if it is necessary to conduct so-called raids, then representatives of the National Police must be involved in this group. They are the ones who check the documents. After that, they provide information to TCC employees to check whether such a citizen of Ukraine is in the register of those liable for military service or not,” Lubinets said.



He explained that it is the National Police officers who “have the right to stop people, check documents, make decisions, voice some legal demands.”.

Lubinets added that he is against expanding the powers of the TCC, which was proposed in the first edition of the bill on new mobilization rules.

Earlier, Anastasia Tsybulko, a lawyer at the GRACERS law firm, explained whether it is necessary to pay a fine for failure to appear at the TCC if the summons was dropped in the mailbox.
