Specialists of the “Legal Adviser for IDPs” told how the procedure for determining disability has changed due to the war.

In May, the Decree of the Cabinet of Ministers No. 452 came into force, which determined that the establishment of a causal relationship between the fact of disability and the fact that such disability occurred as a result of injuries or other damage to health received from explosives, ammunition and military weapons is carried out on the basis of a decision of the profile.

An interdepartmental commission, whose task is to establish causal relationships, is formed under the Ministry of Veterans Affairs. The causal relationship between disability and wounds or other damage to health received from explosives, ammunition and military weapons for civilians will be established by MSEC based on the relevant decision of the interdepartmental commission under the Ministry of Veterans.

The list of territories was also clarified, where persons received injuries or other health injuries, on which it gives grounds to believe that disability came from explosives, ammunition and military weapons:.

until December 1, 2014. - the territory of the ATO, the implementation of measures to ensure national security and defense, repulse and deter the armed aggression of the Russian Federation in the Donetsk and Luhansk regions;

since December 1, 2014. to February 24, 2022. - the territory of the ATO, the implementation of measures to ensure national security and defense, repulse and deter the armed aggression of the Russian Federation in Donetsk and Lugansk regions, where state authorities exercise their powers, and in settlements located on the line of collision;

from February 24, 2022. - the territory for carrying out activities necessary to ensure the defense of Ukraine, protect the security of the population and the interests of the state in connection with the military aggression of the Russian Federation against Ukraine.

It was also established that the belonging of the settlement where the damage to health from ammunition was received to the territory of the measures necessary to ensure the defense of Ukraine is determined in accordance with the List of territories where hostilities are (were) conducted or temporarily occupied by the Russian Federation.

How to establish the fact of disability due to war.

For this, for consideration by the interdepartmental commission of the Ministry of Veterans at the address: Museum lane, 12, g. Kyiv, 01001 must be submitted:.

written statement;

copies of the pages of the passport of a citizen of Ukraine and a copy of the certificate of registration of the place of residence (for persons under 14 years old, a copy of the birth certificate is provided);

a copy of RNUKPN;

copies of primary medical records, the forms of which are approved by the Ministry of Health;

conclusion of a medical expert certifying the fact of receiving injuries or other health damage from ammunition;

a copy of the MSEC certificate on the group and cause of disability from a general disease (for adults) or a copy of the conclusion of the LCC (for children);

certificate of absence (presence) of a criminal record;

an extract from the Unified Register of Pre-trial Investigations, formed no later than 3 months before the person applied with an application;

other documents (if any) that can certify that the injured person received health damage.
