Martial law continues in Ukraine due to Russian military aggression. At this time, certain rules of labor relations between the employee and the employer apply.. Specialists of the North-Eastern Interregional Department of the State Labor Service told whether an employer can postpone the medical examination of employees for the period of martial law or allow a person who has not passed it to work.

Experts noted that in Ukraine there are no regulations or other administrative documents, on the basis of which the employer can postpone the medical examination of employees or allow those who have not passed the medical examination to work.

So, according to. 1 st. 17 of the Law " 10. 1992 No. 2694-XII, art.. 169 of the Labor Code of Ukraine, the employer is obliged at his own expense to provide funding and organize preliminary (when hiring) and periodic (during employment) medical examinations of workers engaged in hard work, work with harmful or dangerous working conditions or those where there is a need.

The procedure for medical examinations of employees is fixed by the " 05. 2007 No.

The specialists emphasized that the employer is responsible for the timely completion of mandatory medical examinations by employees and for the harmful consequences for the health of employees caused by the admission to work of persons who have not passed mandatory medical examinations..
