Employment: what people with disabilities need to know

During martial law in Ukraine, labor relations are regulated by the relevant legislation. Persons with disabilities, according to the Constitution and other legislative acts, have socio-economic rights and freedoms.

Specialists of the Department of Inspection Activities in the Sumy Region of the North-Eastern Interregional Department of the State Labor Service told what rights people with disabilities have in employment and what documents they need for this.

So, according to part 2 of article 24 of the Labor Code of Ukraine, when concluding an employment contract, a citizen is obliged to present a passport or other identity document, a work book, and in cases provided for by law, also documents on education (specialty, qualification), on the state.

“That is why, when hiring, persons with disabilities must also submit documents confirming their disability, namely a certificate from the medical and social expert commission and an extract from the examination report at the medical and social expert commission (MSEC), the employer is left with copies of them and an individual rehabilitation program for a person with a disability.

The documents indicate the group of disability and its cause, as well as the terms and conclusions of the commission on the conditions and nature of the work of the person.

When hiring, employers cannot establish tests for employees with disabilities sent to work in accordance with the recommendation of the medical and social examination. This is determined in accordance with part 3 of article 26 of the Labor Code of Ukraine.

Experts noted that the conclusion of the MSEC on professional suitability is included in the individual rehabilitation program for a person with a disability and is the basis for professional orientation..

“The decision of MSEK and the individual rehabilitation program are mandatory for implementation by executive authorities, local governments, enterprises, institutions, organizations, rehabilitation institutions, regardless of departmental subordination, type and form of ownership,” they explained.



The legislation also provides for ensuring the labor rights of persons with disabilities.. They have a number of benefits and guarantees, the implementation of which in practice aims to prevent discrimination against persons with disabilities in the labor market and the realization of their labor rights in full.
