General mobilization: how to confirm the diagnosis during the passage of VVC

Lawyers Irina and Vladislav Leonov explained how a person liable for military service with serious health problems can confirm his unfitness for military service.

The degree of fitness for military service, the list of diseases, health disorders and issues of military medical examination of military personnel are regulated by the Regulations on military medical examination in the Armed Forces of Ukraine, approved by order of the Ministry of Defense of Ukraine dated 14. 08. 2008 No. 402.

Accordingly, in the said Regulation there is a Schedule of diseases with articles and points of diseases, as well as with explanations for the articles of the disease and tables of additional health requirements. Among them, there are those that suggest unsuitability for military service..

A person liable for military service is mandatory sent to a medical board to determine the degree of suitability based on the conclusion of the IHC. All available medical documents can be submitted to the commission in order to increase the possibility of establishing a correct diagnosis..

The main thing is that the diagnosis should be recorded in the conclusion of the medical board in the way that the Schedule of Diseases suggests.. If the VVK writes down the illness in this way, and this will correspond to the explanations in the Schedule and suggest unfitness for service, then the military ticket will make an entry about unfitness for service with an exception from military registration.

When applying to the military registration and enlistment office, it is not necessary to write an application for a diagnosis and deregistration, this is not provided for by law. But at the commission, you must definitely declare this and provide documents with a diagnosis and control the process for compliance with the records in the military registration and enlistment office with your conclusions.

If a person with had an established disability or other grounds for obtaining a deferment, then in this case it would be necessary to write an application.



If there is a confirmed diagnosis and this is a serious illness, then after the examination on the commission, the doctor will enter information about complete unsuitability and indicate the corresponding article of the disease schedule in the conclusion, then the VVK will be obliged to take this moment into account when making a decision.

If a person does not agree with the conclusions of the medical examination set out in the decision of the IHC, the only way out of this situation is to appeal such a decision in a pre-trial or judicial procedure..
