General mobilization: how to confirm the right to exemption from it on the basis of caring for the disabled

General mobilization in Ukraine and martial law declared. Currently, all men of military age who do not have grounds for exemption from mobilization, provided for by Ukrainian legislation, receive summons and join the Armed Forces of Ukraine.

Vladislav Zaytsev, a lawyer assistant of ARES Law Firm JSC, a member of the Council of the Ukrainian Bar Association Committee on Migration Law, a volunteer lawyer of the UBA Hotline on issues related to military aggression, its consequences and martial law, in an exclusive commentary to ZN. UA told how to prove the right to exemption from mobilization on the basis of caring for the disabled.

“According to the current legislation, a deferment from conscription for military service during mobilization has, in particular:.

persons engaged in constant care for a person with a disability of group I;

persons engaged in constant care for a person with a disability of group II in the absence of other persons who can provide such care.

What documents can confirm the deferment from conscription for the above categories of persons?

When caring for a person with a disability of group I, the following documents should be submitted:.

documents confirming the disability of a person in need of constant care (MSEC certificate);

documents confirming the need for ongoing care (conclusion of a medical and social expert commission or a medical advisory commission of a healthcare institution that a person with a disability needs constant care).

To confirm the existence of a delay in the case of caring for a person with a disability of group II, the same documents are needed, as well as documents indicating the absence of other persons who can provide such care.



For example, if a person is alone and does not have close relatives, such documents may be death certificates of relatives, a certificate of registered persons (at the place of residence of a person with a disability), an act of examining the living conditions of a person with a disability, etc..
