General mobilization and martial law continue in Ukraine, which were introduced due to the full-scale military invasion of Russia. Men liable for military service between the ages of 18 and 60 are subject to mobilization..

Until February 24, 2022, many Ukrainians were outside of Ukraine - some returned, and some did not. Lawyer Rostislav Kravets told ICTV Facts whether there is any liability for men who left before the start of a full-scale war and did not return.

According to the expert, responsibility for failure to return to Ukraine during martial law has not been established.

“Currently, there is no such responsibility.. People's deputies are trying, there were several bills that were aimed at introducing liability for the non-return of men to Ukraine,” the lawyer explained.

He stressed that the adoption of such a law would not meet the norms of the Constitution of Ukraine..

“As for forcing men to return, in fact, this is not only a violation of the Constitution, but also a violation of the logic. After all, the flow of finance to Ukraine from migrant workers begins to exceed earnings from exports,” Kravets added..

The lawyer noted that the introduction of certain fines for men who return would be a violation of the Constitution and human rights.



“Also, the law does not provide for forced mobilization in the event of the return of a man who was abroad before the war,” he concluded..

Kravets stressed that if a man received a summons, but he somehow went abroad after February 24, 2022 and did not appear at the military registration and enlistment office, then administrative liability is provided for this.. In other cases, there is no liability for non-return.
