Lawyer Dmitry Donchak told how the booked person should act if he was served with a summons.

Such a person has the full right to either receive the summons and sign for its receipt, or refuse to sign for the receipt of the summons.. But refusal to sign will give absolutely nothing - in this case, two witnesses will be found who will sign the act of refusal to sign, and thus dispense with the signature, while from a legal point of view, the summons will be considered served properly and for failure to comply with the requirements.

He stressed that, despite the availability of documents confirming the reservation, such a person is still liable for military service, and therefore must comply with all the requirements of the law, in particular the Law of Ukraine " That is, it must promptly report to the TCC about all changes in its life: a change in the address of residence, a change in marital status, the birth of a child, periodic health checks for fitness for military service, etc.. Since almost no one does this, TCC employees are forced to take such extreme measures as issuing subpoenas. Including - on the street.

The lawyer recalled that there are several types of subpoenas, and first of all, a subpoena is served to clarify credentials. It is necessary to come according to this agenda, and at the same time take with you the original documents confirming the reservation. After clarifying all the credentials, with a high degree of probability, such a person will be issued a summons - a call for a medical examination (VVK) - to check the status of fitness for service. It is also absolutely legal, even if there is a reservation or other grounds that provide a respite from mobilization.

“After passing the medical examination, given the availability of a reservation, you will be released. If there was no booking, theoretically after the VVK they could issue a summons to send. But this does not mean at all that those liable for military service who do not have grounds for deferment are necessarily handed a summons to send,"

He also noted that when trying to serve the summons, the booked worker can show the TCC representatives your booking documents, but this does not mean that after that they will immediately release him, because the armor documents will need to be shown already at the military registration and enlistment office.

Thus, the correct algorithm of actions:.



take the agenda;

sign to receive it;

come to the TCC at the time specified in the agenda. Take your passport, your military registration document, and an extract from the booking order with you;

if necessary, undergo a medical examination.
