OASK denied Yanukovych two lawsuits with which he wanted to return the title of president

Viktor Yanukovych, who is hiding in Russia, sued the Kyiv District Administrative Court against the Verkhovna Rada for the second time in January. Yanukovych, convicted in absentia for high treason, wanted to regain the title of president through a lawsuit against parliament.

The representative of the Verkhovna Rada in the Constitutional Court, Olga Sovgirya, said that Yanukovych demanded the UAC to recognize that the Ukrainian parliament has no authority to deprive the title of president of Ukraine through a procedure other than impeachment. The Verkhovna Rada deprived Yanukovych of the title of President of Ukraine due to the adopted and current law of February 4, 2015 No. 144-VIII.

Sovgirya said in January that a court decision on this lawsuit could be made at almost any moment..

The constitutionality of this law has already been challenged in the Constitutional Court, however, in December 2019, the Constitutional Court closed the proceedings on this constitutional submission.. The CCU noted that this dispute is not within the jurisdiction of the Court, since it is not legal, but is of a political nature..

UA was informed that on April 20, 2022, Judge of the District Administrative Court of Kyiv Yevhen Ablov refused to satisfy the petitions of the Verkhovna Rada to close the proceedings and transfer the case under jurisdiction to the Cassation Administrative Court as part of the Supreme Court. Judge granted motion to dismiss case. Yanukovych's administrative proceedings on recognizing the lack of authority, the judge decided to leave without consideration. The decision of the court, according to. 2 Article 256 of the Code of Administrative Procedure of Ukraine, enters into force from the moment it is signed by a judge. It could be challenged in the court of appeal within 15 days.

Immediately after him, on April 21, 2022, judge Igor Kachur granted the request of the representative of the Verkhovna Rada to leave the claim without consideration. The judge left without consideration the administrative claim N640/34786/21 on the claim of Yanukovych against the parliament on the lack of competence of the subject of power.
