The public organization "Rada of the community of Bezpek" received an oral appeal from the residents of the Shkolny microdistrict with information on the placement of temporary trade facilities (hereinafter the CU) at the address:. Odessa, pr. Heavenly Hundreds, 10.

Representatives of the Russian State Library familiarized themselves with the situation on the spot and informed the mayor that temporary commercial buildings were placed in violation of legislative norms and requirements, namely:.

- placed on a pedestrian walkway, which leads to daily risks in relation to the health and life of residents of the Shkolny microdistrict, who are forced to walk along the carriageway of an internal quarterly passage, moving between cars passing very close at high speed;.

- the distance from one of the vehicles is less than 20 meters to the intersection of Shkolnyi Aerodrom street and the intra-block passage;.

- to the locations of the vehicle is not provided for easy access of vehicles for unloading or loading of goods, which creates significant obstacles for the passage of pedestrians;.

- the distance from the vehicle wall to the carriageway is not more than 30 cm, which is a significant violation of the Cabinet of Ministers of March 30, 1994 N 198 (Revision of 05. 04. 2017) "On Approval of the Uniform Rules for the Repair and Maintenance of Highways, Streets, Level Crossings, Rules for Using and Protecting Them", namely, Section V, p. 27 "In settlements, small architectural forms (except kiosks for selling tickets for public transport stops) are located outside the sidewalk, walkways, alleys at a distance of NOT less than 1 meter, but no closer than 5 meters to the roadway.

Considering the above, we ask the head of the City Council to urgently intervene in the situation in the Shkolny microdistrict and bring order to the accommodation of the vehicle, which are installed in violation of the legislative norms of Ukraine and threaten the life and health of the representatives of the territorial community of Odessa.

In accordance with the requirements of the Law of Ukraine "On citizens' appeals", we ask the Chairman of the Odessa City Council to answer the following questions:.

- Does the “Temporary Structures” section of the City Planning Cadastre of Odessa (http: // service. ombk. odessa. ua /. / ap. / webappviewer / index. html. ) complete information on temporary structures r. Odessa with a package of documents that is relevant on the date and time of application to the registry (at least 2018.

- Can representatives of the territorial community, conducting public control over the legal placement of the vehicle in Odessa, be guided by the documents and information posted on the website (http: // service. ombk. odessa. ua /. / ap. / webappviewer / index. html. ), considering that most of the documents listed on the site have lost their legal force, namely, their validity has expired.

We ask the city head Trukhanov G. to pay attention that the urban planning cadastre of Odessa is a source of open information and is used to monitor and analyze the situation with the vehicle in Odessa.

- We ask the mayor to provide information on the availability of approved integrated schemes for the placement of temporary structures for business activities in g. Odessa, designed to meet the requirements of construction, sanitary and hygienic standards, as well as the existing urban planning restrictions, requirements for environmental protection and rational use of territories, protection of historical and cultural heritage, land and economic structure, and always with details of the location of the vehicle, number and the date Decisions of the Executive Committee of the Odessa City Council.

- In order to exercise public control over the legality of the activities of entrepreneurs and the placement of the vehicle by them, we ask you to detail the list of documents that should be posted publicly available, namely in a prominent place / in the field of view of the consumer or any representative of the territorial community.

- Provide passports binding the vehicle and a vehicle improvement scheme located in the Shkolny microdistrict, certified in accordance with the legislative requirements of Ukraine.

We ask the mayor to provide information on the results of the inspection of the location of the vehicle in accordance with legal regulations, together with an analysis of the above facts..
