The Specialized Anti-Corruption Prosecutor's Office (SAP) appealed against the decision of the investigative judge of Solomensky court of Kiev to elect a measure of restraint to former People's Deputy of Ukraine Nikolay Martynenko.

"Today, April 26, 2017, SAP prosecutors filed a complaint with the Court of Appeal of the city of Kiev against the decision of the investigative judge of the Solomensky court on April 22, 2017 to elect a preventive measure against Nikolai Martynenko," the press service of the SAP.

The head of the Specialized Anti-Corruption Prosecutor's Office, Nazar Kholodnitsky, considers the measure of restraint chosen by the court to be groundless neither from a legal point of view nor from the point of view of the gravity of the offenses suspected by the former people's deputy.

"From a legal point of view, the chosen measure of restraint does not correspond either to the gravity of the crime committed, nor to the risks stated in the petition, which are much wider than was stated in the meeting. This decision actually legalized the pressure on the court by the people's deputies, as an instrument to induce a certain decision, or more precisely, restrictions on the choice of preventive measures on the part of the judge, "Kholodnitsky.

The SAP insists on the cancellation of the decision of the court of first instance and the issuance of a new decision according to which the suspect will be selected as a preventive measure in the form of custody for 60 days with an alternative to making a pledge of 300 million UAH. They also stressed that they would appeal the short text of the court decision, since the full one will only be available on the last day of the time limit for filing an appeal.

"I would like to additionally note that nothing significant, except reputational risks, the court of first instance chosen by the court of first instance does not threaten the guarantors. The maximum amount of a fine in the event of failure to perform duties by a suspect is 50 subsistence minimums, 80 thousand UAH for able-bodied people, which is not yet easy to recover, taking into account additional guarantees for the independence of people's representatives. And this despite the fact that Nikolai Martynenko is suspected of organizing the seizure of funds in the amount of more than 17 million US dollars, "- concluded the head of SAP.
