"Lausanne, February 20, 2018. The Sports Arbitration Court dismissed the complaints filed by FC Dynamo (Kiev) regarding its three teams (ULP, U-21 and U-19) against the Football Federation of Ukraine (FFU) in connection with the decisions adopted by the FFU Appeal Committee (AK FFU) on November 14, 2017. of the year. In these decisions, the AK FFU confirmed the decisions taken by the FFU Control and Disciplinary Committee, which decided to count the technical defeats to the Dynamo Kiev teams (ULP, U-21 and U-19) for not participating in matches with Mariupol teams and imposing a penalty on Dynamo teams.
In their appeals filed December 8, 2017 in the CAS, FC Dynamo (Kiev) justified its absence in Mariupol based on information received from law enforcement agencies that confirmed the danger of holding matches in this city because of the military conflict in the region. FC Dynamo (Kiev) claimed that he had a really good reason for not visiting these matches in accordance with the applicable rules. On February 12, 2018, at the headquarters of the CAS, hearings were held at the CAS Commission (Mr. Sofocles Pilavios, Greece, (President), Mr. Michel Bernasconi, Switzerland and Mr. Hendrik Kesler, the Netherlands) their representatives and witnesses.
The Commission found that since the relevant matches were not banned by any local or state body, the leadership of the Premier League of Ukraine, according to the rules currently in place, can independently determine whether there were reasonable grounds or force majeure circumstances for postponing or transferring the relevant matches. Since FC Dynamo (Kyiv) did not submit such a request to the Ukrainian Premier League for decision-making, the commission concluded that all appeals should be rejected, without the need to determine whether there were security problems in the region, which was a good reason for FC Dynamo (Kiev) for lack of matches. At the same time, the commission also determined that the FFU failed to clarify the situation in a timely manner and communication between the parties was unclear, and, thus, the resulting confusion caused damage to Dynamo Kiev. As a result, the commission decided that the costs of arbitration should be distributed in equal shares between the parties.
Since the decision in this case affects the distribution of teams following the results of the first stage of the championship of Ukraine and, since the second stage is scheduled to start on March 10, 2018, the commission adopted its decisions without declaring the grounds for them. A full arbitration award, including the reasons, will be published in the near future ".
