The Supreme Court recognized as legitimate indefinite use of cars on evronemera imported into the country in the "transit" mode. This is stated in the press service of the Supreme Court.. "The use or disposal of vehicles imported for the purpose of transit through the customs territory of Ukraine is not an administrative offense under h.. 2 st. 469 of the Customs Code of Ukraine ", - stated in the message. The essence of the dispute lies in the fact that the plaintiff, being the owner of the car with the registration number of Estonia, not removed from registration there, on February 26, 2016, imported this car into the customs territory of Ukraine on the basis of a customs declaration for the purpose of transit.

During the court hearings, the plaintiff himself admitted that he had imported the specified vehicle for long-term use, and indicated the “transit” regime in order to avoid the need for customs clearance of the car and the payment of appropriate payments. The appellate court, having canceled the decision of the court of first instance, refused to satisfy the claims. In turn, the claimant did not agree with this decision and appealed against it in cassation, referring to the decision of the Constitutional Court, which stated that the use or disposal of personal vehicles imported for the purpose of transit through the customs territory of Ukraine is not an administrative offense.
