The investigation into the case of the murder of one of the leaders of the "Ukrainian Truth" Pavel Sheremet did not establish in the crime signs of a terrorist act.
This is stated in the explanations that the Prosecutor General's Office provided in response to the statement of the editor of the UP Alena Prituly.
"The subjective side of the crime under art.. 258 of the Criminal Code ("terrorist act" - UP) provides for violations of public security, intimidation of the population, provocation of a military conflict, international complication, influence on decision-making or committing or failing to act by public authorities, "the GPU.
At the same time, the department claims that "at the time of registration of production and to date, such signs have not been established".
Also, law enforcement officials say that the examination has established the power of the explosive device - from 350 to 700 grams in TNT equivalent. The investigation insists that this is a "relatively small amount for the defeat of many goals".
"The way of fixing the device, the direction of the blast wave and its damaging elements exclusively in the interior of the car (the driver's seat itself) exclude the possibility of hitting other persons," says the clarification.
The GPU says that their SBU supervisors studied criminal proceedings and also did not establish grounds for qualifying the murder as an act of terrorism.
It is also reported that the prosecutor, who is the procedural leader in the case, and two investigators of the National Police were released from other investigations to concentrate "efforts solely on this production".
Concerning the demand of Alena Prituly to recognize her as a victim in the case, the GPU replied that "the rights and obligations of the victim arise from the moment he filed an application for a crime or an application for involvement as a victim".
"Such a statement from Alena Pritula (20. 07. 2017), as well as the mother of journalist Sheremet Lyudmila Stanislavovna and daughter Elizabeth (21. 07. 2017) came to the investigators of the National Police. After the applications, all victims were given a memo about the procedural rights and duties of the victim, in which their signatures are, "the Prosecutor's Office.
They also argue that in the current CPC there is no direct requirement to issue a resolution on bringing in as a victim.
Earlier it was reported that Alain Pritula filed a complaint with the court demanding to recognize her as a victim and re-qualify the case for an act of terrorism.
In addition, as early as February 27, 2018, the civil wife of Sheremet appealed to the Attorney General with a statement in which she asked to investigate this case as an act of terrorism that led to the death of a person.
