A paradoxical situation occurred in the Sverdlovsk region: the uralochka and her husband were forced to owe money to Sverdlovskavtodor for falling into a pothole on the road.
According to the press service of the regional court, the incident occurred in 2015. The old Cadillac YSCF hit the Novomoskovsk tract in a pothole on the road. The owner of the car and her husband, sitting behind the wheel, called the traffic police and compiled an act of identified shortcomings in the maintenance of the road. According to the act, the pothole exceeded the standards set by GOST. Expertise estimated the damage from an accident almost half a million rubles.
At the court, the car owner asked to collect from the road workers the amount of damage, the payment of expert services (3 thousand rubles), the services of a lawyer (20 thousand rubles), the diagnosis of the UKCP (25,110 thousand rubles) and the state duty (8,399 rubles).
The court of first instance established that an accident occurred during the daytime, which means that the driver had the opportunity to see the interference. In addition, he had to move at such a speed that, after seeing a pothole, he had time to stop. In view of these circumstances, the court concluded that the driver is guilty of an accident.
The defendant appointed his expertise, which concluded that as a result of the collision on the pothole, Cadillac received only hernias of two tires. All other damage is the result of natural wear and tear of an old foreign car. The amount of damage experts have reduced to 7,5 thousand rubles.
The court went to meet the plaintiff and collected from Sverdlovskavtodor a little more than 7 thousand rubles and 5 thousand rubles for the work of a lawyer. In turn, the plaintiff in favor of the defendant collected expenses for expert services in the amount of almost 10 thousand rubles and in favor of the Ural Center for Independent Expertise 30 thousand rubles.
Sverdlovsk regional court reviewed the plaintiff's appeal and found no violations in the decision of the court of first instance. The decision remained in force.
