Four cases "Ukraine vs. Russia" gave a "green light" in the European Court of Justice

The Chamber of the European Court of Human Rights (ECHR) decided to transfer four cases of "Ukraine vs. Russia" to the Grand Chamber of the Court concerning violations of human rights in the occupied Crimea and eastern Ukraine.

This is stated in the ECHR report.

"The Chamber of the European Court of Human Rights, which considers four interstate declarations filed by Ukraine against Russia, decided to renounce jurisdiction over them in favor of the Grand Chamber," reads the statement..

In the Grand Chamber, 17 judges, while in standard cases, the decision of 7 judges of the ECHR.

The Grand Chamber is authorized to consider only those cases that were transferred to it and in only three cases the Chamber may waive its jurisdiction in favor of the Grand Chamber under certain circumstances. In particular, this happens if the case, which the Chamber is considering, raises a serious question concerning the interpretation of the European Convention on Human Rights and its protocols.

The cases referred to concern Ukraine's accusations of violations of the European Convention on Human Rights by Russia and armed groups, which the Russian Federation controls. Statements were filed on several counts, including article 2 (the right to life), article 3 (prohibition of torture and inhuman or degrading treatment), article 5 (right to liberty and security), article 6 (right to a fair trial).

In the first two cases, the Government of Ukraine maintains that since 27 February 2014 the Russian Federation, exercising control over the Crimea, which is an integral part of Ukraine, and also exercising control over separatists and armed groups operating in the east of Ukraine, has led to numerous violations of the Convention.

The other two cases cover events in the Crimea and Eastern Ukraine since September 2014. The Government of Ukraine claims that the Russian Federation has established control and continues to control the Crimea and, by controlling separatists and armed groups, in fact controls the areas of Donetsk and Lugansk. Thus, the Ukrainian government insists, Russia is responsible for numerous violations of the Convention in these areas.



Recall, the first complaint to the ECHR Ukraine filed March 13, 2015, it concerns the seizure of Russia by the Crimean Peninsula and the events that occurred later in eastern Ukraine. The complaint concerns numerous violations of human rights.

Among the claims to Russia - the Russian Federation the use of compulsory citizenship in the Crimea.

Ukraine has filed five complaints to the ECHR regarding the actions of the Russian Federation regarding the illegal annexation of the Crimea, as well as Russia's responsibility for the events in the Donbass.
