As reported in the prosecutor's office of the Sverdlovsk region, Lyudmila Vasilenko, knowing about the unfitness of an apartment house in the village of Kunarskoe of Bogdanovichi district for residing in connection with the fire that occurred in August 2015, on November 10 of the same year concluded a contract of sale of the above-mentioned house in the ownership of himself and Of their young children.
Under the terms of the contract, she assumed the obligation to make settlements for the acquired house by means of the parent capital. To this end, in December 2015 she applied to the management of the Russian Federation pension fund in Bogdanovich with a request to dispose of funds of maternal (family) capital in the amount of over 433 thousand rubles to pay for the purchased house without informing about the fact of fire and unfitness of the home for living.
In court, the state prosecutor proved that Vasilenko subsequently appropriated the money without actually improving the living conditions of her children, causing damage to the federal budget for the specified amount.
The court found the young mother guilty of committing a crime,. 3 items. 159. 2 of the Criminal Code of the Russian Federation (fraud on receipt of payments in a large amount) and sentenced a prison sentence of 1 year 8 months probation with a probation period of 2 years.
