The Prosecutor's Office of the Sverdlovsk Region conducted an audit of compliance with federal legislation by the administration of the Beloyarskiy urban district with the disposal of land. In the course of supervisory activities, the department established that in September 2015 the committee for managing municipal property of the administration of the Beloyarskiy urban district and JSC "Revdinsky brick factory" entered into a lease agreement for a land plot with an area of ??over 111 thousand square meters for a period until September 2020 with a designated purpose - for Agricultural use.

However, the brick factory has nothing to do with agriculture, therefore, for the stated purposes the site did not use. Instead of growing wheat or, for example, pasturing cattle, the plant used it for its professional activities - mining clay for the production of bricks, and also built on it a new workshop.

Since the condition that the parties agreed on in the part of the permitted use of the land plot does not correspond to actual circumstances, the prosecutor's office came to the conclusion that when a land lease contract was concluded, a feigned deal was made.

In connection with the above, the deputy prosecutor of the Sverdlovsk region appealed to the Arbitration Court of the Sverdlovsk region with a statement in the order of.

52 of the agrarian and industrial complex of the Russian Federation to the committee on management of municipal property of the administration of the Beloyarskiy urban district, JSC "Revdinsky brick factory" on invalidation (null) of the land lease contract.

By the decision of the Arbitration Court of the Sverdlovsk Region, the requirements of the Prosecutor's Office were met in full, the respondents are charged with the obligation to return the land to the disposal of the municipality.
