Kharkov patrolman intends to continue litigation with local auto-mechanic

Protection patrol Denis Dufek today appealed against the decision of the Frunzensky District Court of Kharkov, which refused to satisfy the law enforcement officer's claim to protect the honor, dignity and business reputation of the video blogger Vitaly Boychenko.

An appeal to the appeal was also added a videotape disc, which, according to the defense, confirms the defendant's connection to the YouTube channel "The Master of the Court".

"We hope for the cancellation of the decision of the first instance as illegal and the satisfaction of our claims in full," said Alexander Nikolsky.

The court decision, which the lawyer published on Facebook on June 6, notes: "In defending the claims of Dufek Denis Olegovich to Boychenko Vitaly Yurievich on defending honor, dignity and business reputation and compensation for moral damage - refuse".

Among other things, the court considers that "the plaintiff did not prove the fact of dissemination of the above-mentioned information on the Internet" and "no evidence of the site's belonging" (YouTube channel - ed.. ) "The master of the court" to the defendant ". The court also does not agree that Denis Dufek in the conflict acted as an individual, and not as a representative of the authorities.

The patrol sued the "road" activist, demanding compensation for moral damage in the amount of 107 thousand hryvnia, after the publication of a video in YouTube with the recording of the incident between Vitaly Boychenko and the patrolmen on December 31.



On that day, the patrol crew stopped the car on Petrograd Grigorenko Boulevard, and while one of the law enforcers communicated with the driver Boichenko drove up and said that he was authorized to provide legal assistance. "Road" activist insulted the patrol, the video later laid out on YouTube.

In mid-May, the parties met in court. Vitaly Boychenko said that he is not the author of the video recording, but only a "participant" and did not recognize that he has a relationship with the YouTube channel "The Master of the Court".

On June 1, the Frunzensky District Court of Kharkiv denied a claim for protection of honor, dignity and business reputation.
