The Government of Spain believes that for the release of seriously ill prisoners, their expected life expectancy should be less than two months. According to information agencies of the country, the relevant information appears in the written response of the authorities to the senator from the association EHBildu Ion Inyarritu, published on Sunday. Inyarritu appealed to the government with a question about the February instructions for correctional facilities, which stated that sick prisoners can be released "only if their deaths are predicted with relative accuracy in the short term, or if they meet the requirements for transfer to The third degree of punishment (implying an open prison regime) or for conditional release ".

The senator asked the authorities to clarify this provision, and government officials explained to him that the main purpose of this measure is to adapt to the new regulations of the Criminal Code. According to them, "prisoners whose illness is an obvious threat to life must be immediately released from prison on the basis of a relevant judicial decision based on medical reports".

The Government decided that in cases where illness or old age pose a threat to the life of a convicted person, sufficient medical conclusions and an assessment of the degree of its safety for society. The above-mentioned conditions of the authorities were defined as life-threatening for those cases when its expected duration is less than two months. The government also recalled that each case would be treated on an individual basis and exclusively on the basis of medical data without taking into account subjective criteria.
