The rights of purchasers of previously privatized housing will be protected

The website of the Cabinet of Ministers contains a document from which it follows that the Russian government has submitted to the lower house of parliament a draft law on the protection of the rights of purchasers of previously privatized housing.

"Izvestia" reported that the bill proposes to prohibit the demand for a claim for previously privatized housing from a bona fide purchaser.

President of the Guild of Real Estate Lawyers Oleg Sukhov explained to the newspaper: "There will be no negative consequences of such a law, and its scope will not be too broad. Speech basically goes about single cases when the conscientious purchaser can lose the privatized apartment only because the official of the state body was mistaken, all information was not taken into account, and so on ".



The expert is sure that the law will protect only bona fide purchasers, that is, those who could not know that the apartment for some reason can not be privatized or is removed from the possession of government agencies in addition to their will.

Sukhov concluded: "The abuse of these changes can become a negative moment - if citizens privatize apartments with violations, and then prove that they knew nothing about them. However, in order to combat this, in each case the courts will have to be convinced of the honesty of the owner ".
