RIA Novosti reports that the Supreme Economic Court of Ukraine rejected a cassation appeal from Gazprom demanding that the decision of the previous courts to cancel a fine of UAH 171.8 billion (about $ 6.4 billion) in Ukraine for allegedly abusing the monopoly position in Ukrainian Gas transit market.
Gazprom filed a complaint in March of this year. The decision can be appealed in the Supreme Court of Ukraine.
As previously reported, the Antimonopoly Committee of Ukraine (AMCU) in 2015 issued a fine to Gazprom for abusing the monopoly position in the gas transit market during 2009-2015 at a rate of 86.86 billion hryvnia (3.2 billion dollars). Then "Gazprom" expressed surprise at this decision, as it does not conduct business in Ukraine, passing gas to "Naftogaz".
However, Gazprom's attempts to achieve the cancellation of this decision in the Ukrainian courts were not crowned with success. AMCU last autumn sent a lawsuit to the Economic Court of Kiev on compulsory recovery from the company of the entire amount of the fine, as well as fines for the same amount for late payment. As it became known, the lawsuit for a total amount of about 6.4 billion dollars was satisfied by the court in December last year. However, Gazprom filed an appeal against this decision, which was also rejected.
