The international organization Amnesty International, with a report on the tactics of the Armed Forces of Ukraine, actually demonstrated that theorizing about war often diverges from reality and any analytics should take into account the context. This was announced by the former Deputy Prosecutor General of Ukraine Gunduz Mammadov.
According to him, the arguments given by Amnesty International in the report are not enough for a legal assessment, and the assertion that the Armed Forces of Ukraine use human shields as a tactic is unfounded, early and will be a weapon in the information war.
In particular, Amnesty International in the report is guided primarily by the provisions of Additional Protocol I, from which Russia withdrew in 2019.
" 28 Geneva Convention IV and 51(7) Additional Protocol I. The last paragraph is devoted to the indiscriminate attacks of the RF Armed Forces on the civilian population and objects on the territory of Ukraine. However, there is no mention of the principle of proportionality in the use of force, even against military targets, if it could threaten the death or injury of civilians,"
In the report, the organization actually accuses the Armed Forces of Ukraine of not taking " However, as Mammadov notes, experts do not give an answer on how the evacuation should look like, since the commentary to Additional Protocol I says that Article Art. 58 on precautionary measures regarding the consequences of an attack (evacuation of the population) does not require an impossible.
“Further, it should be understood whether the Russians violate the principle of proportionality, enshrined in Art.. 51(5)(b) in Additional Protocol I, by opening fire on UAF locations in cities? It is obvious that they are violating,” Mammadov points out..
Also, the report does not contain proper evidence, making it impossible to consider each episode on the merits.. Therefore, according to Mammadov, every fact of a possible violation of the norms of international humanitarian and criminal law, including by Ukrainians, should be studied and investigated in detail..
" But is it worth the potential consequences: the discrediting of the Armed Forces of Ukraine, the use of Russian propaganda and, in the end, the rejection by Ukrainians of future reports of international organizations, which may contain a more balanced opinion and constructive criticism,"
